The Enforcement Directorate (ED), which is seeking cancellation of bail granted to Tamil Nadu minister Senthil Balaji, told the Supreme Court on Friday that the case against him in the money laundering case has “already been smashed”.
Solicitor General Tushar Mehta, appearing on behalf of the agency, informed the bench of Justices AS Oka and Pankaj Mithal. Justice Oka said the recall application should be heard by the same bench that granted him bail and fixed December 18 for hearing. Balaji was granted bail on September 26, 2024 by a bench of Justices Oka and AG Masih.
Later in the day, the ED filed an affidavit in the court and supported its claim that the trial of the case has been “sabotaged”. Within 48 hours of his release on bail, the Tamil Nadu government inducted him into the cabinet as Minister for Power, Prohibition and Excise, the affidavit said.
It expressed concern about the potential impact of Balaji’s reinstatement as some of them had previously worked under him. “From the date of Balaji’s release on bail, PW4 failed to appear continuously for 2 hearings and sought adjournment due to ill health. Thereafter the court issued NBW for Rs.1000/ 4.10.2024 and he was compelled to produce himself due to pending NBW,” the agency said. said
